Apple May be Banned in the US

Motorola vs Apple 300x180

Apple over the last few months has sued Samsung, HTC and Motorola making it very difficult to make a device that doesn’t supposedly infringe on any patents they claim are theirs. Well, at the U S International Trade Commission, Motorola Mobility has filed its second lawsuit against Apple. If Moto is successful, this will effectively ban the sale of all iPhone, Mac and iPads from being sold in the United States.

Google Owned Motorola Mobility made this statement:

We would like to settle these patent matters, but Apple’s unwillingness to work out a license leaves us little choice but to defend ourselves and our engineers’ innovations.

Apple has been accused of breaching Motorola patents pertaining to location services, media playback on phones, (voice command)Siri, push email notifications and many others. Google knew what they were doing when they bought Motorola, with a case already under their belt against Apple in Germany. The success of this case over data synchronization, stopped iCloud users from receiving push email notifications while in Germany.

Apple, you created this monster, now you are going to have to face the fact that you may not win the battle.

GOOD LUCK APPLE

I have been a Droid addict since I got my first OG Droid (Motorola A855), it took me about 3 months to root and I was hooked. I now have multiple devices and each one of them supplies me with my daily dose of Android love. Outside of Android I also love reef aquariums and I am a workaholic to support my family and three beautiful girls and would do anything for them and love that they are always interested in daddy's Android toys.

You must not be from America. We drive on the right, carry guns, and we let people who have tons of cash do whatever they want…Welcome! If apple wanted to pump out Galaxy S IIIs and Nexus 7s the government would drag their feet all the way to slapping Apple on the wrist, just in time for Samsung, Google, and Motorola to go broke. HA!

  • Pj Almonte

while i dont personally expect this to go through as depicted (banning all sales of apple products) i would like some type of resolution between apple and the android makers. these lawsuits are pathetic because round corners should not be patentable in the first place, and many of the things claimed have prior art. Im not going to lie, the iphone put these things together in a package that had not been seen before, but the sum of the pieces were already in the wild. I saw multitouch on the surface by microsoft before the iphone, cameras where there, touch screens, light sensors, front facing cameras, but the iphone managed to wrap all these up in what really was an amazing leap of standars to make a phone. In short, let them win and lose, have to come to an undisclosed settlement worth $$$ and call it a day. There is seemingly no way to create a device which dodges each patten, so these things are going to happen. The courts should re-examine what constitute FRAND patens and force the settlements between them so these stupid litigations cease to happen.

    • http://gniw.ca Ambrose Li

It’s earlier than that. I was told that multitouch was in fact a 70’s technology. Buried in a research lab for sure, but still much older than we’ve been led to think.

    • http://www.facebook.com/Dhooverphotography Destry Hoover

I see Google shooting down any licensing offers just as Apple has done to every other company that has supposedly infringed on it’s technology. Apple started a war by attacking android manufacturers and getting their technology banned in the US and Germany. They are only getting the same treatment and it’s about time.

Lawsuits and patents are only harm consumers. I dont understand why should i have an iphone to experience “Scroll to unlock” or have a motorolla to have “push emails”. Its insane, brands should stop suing each other and start sharing licences between their discoveries and technologies so that consumers may benefit all the available features up to date.

    • Benjamin Heath

That drives me nuts. It is extortion to make an app that could help a lot of children (I recognize that not all kids learn the same way) only available on a $400-$830 device.

      • http://twitter.com/StephenESC StephenESC

Sorry, but you can’t really call it extortion when someone finally puts the effort into making helpful learning apps for children but only for the iPad. Besides, they’re apps. You’d be hard-pressed to find ANY app-running device less expensive, regardless of OS.

Apple loves to claim that the iPhone is a huge innovation that they are responsible for and Steve Jobs called the Android operating system “a stolen product”. I had a Sonyericson W950i, which was released in February 2006 (11 months before the iPhone was even announced) and it did pretty much everything that an iPhone does, all be it on earlier generation hardware. It was a phone, an organiser, did email, could browse the internet, and it was an mp3 player as well. When I got it I thought “they should make the screen bigger and have a virtual keyboard”. It even had an app drawer that worked just like Androids launcher and looked like the iOS home screen. You could even download apps for it. It ran Symbian and had a UIQ 3 user interface. I don’t know what Steve Jobs was smoking but this and many other examples show that he was certainly not shy about “stealing” other peoples products.

    • Benjamin Heath

And Microsoft stole from Apple, and Apple stole from Xerox, and all this nonsense never ends.

      • Itsallcircuitsmadeatfoxconn

Microsoft actually started it with fucking over IBM back in the day, it’s been a big ol’ circle jerk of IP lawsuits ever since for all tech companies.

    • conqueror

Business is about theft and reputation. The business world is not about who stole, but about who got caught stealing. They are all monsters. Its all a war for money. Its about who can get the most coins out of the poorest beggar.

    • Abhijeet Mishra

Exactly, I would still prefer to use my Symbian phone over getting an iPhone. iPhone was an innovation in that it made touchscreen phones that famous and easy to use, but otherwise there was nothing innovative about it. How Apple fools people and how people worship them is saddening to see.

  • WaRuss

Make sure that no one forgets, Apple owns the patent rights to the external moisture sensor and uses this to control warranty expenses for the IPhone product. This gives Apple an extreme advantage over any Droid phone in that warranty costs can be greatly decreased as Apple will void you like the plague if your external sensor is ever shown to be pink on the outside.

    • http://www.uragon.com/ Bogart

You are 100% right and agree completely. Except, if they take this feature out, any android phone will still work 100%, so your argument doesn’t fly.

  • screw_android

  • Jon Takaki

THis is why I never bought a Mac nor an iphone..Buying a product made by a stingy company that tries to bully its way to market domination is like voting for a dictator. This attitude of Apple reflects the late Steve Jobs approach to life and business. Without him innovation will stall and patent infringement lawsuits might be the only way for Apple to remain dominant. Using the “cool factor” they’re known for and the fashion trend they’re riding will help them for a while unless consumers realise Apple is not as cool as they make themselves to be. However and luckily for Apple, most consumers are stupid as Steve Job knew all too well.

    • conqueror

AGREED remove the A and you get GREED, that’s what drives them all.

Exactly why they said “consumers don’t know what they want” while designing the iPhone/iPad, because they think the consumers are fools and can be told what they can and cannot do with their devices.

Apple dont innovate, they only market wots already available.
Oh and charge you a fucktonne for it… small point about apples ethics – linux = free, but every apple OS is bazed in the linux kernel but they charge hundreds of dollars for it. On top of that, you can build a mac for about a third of the price – the reason they dont want you cracking their shit open is coz nothing inside is actually apple – it will all be either intel/nvidia or amd/ati depending on whether its a mid range or high end machine. If you put linux on it, it wont have cost the earth but will perform like a mac and, oh yea – theres a whole software centre full of over 33,000 apps also for FREE.
You buy apple and you are willingly spending unecessary money making you a fool of epic proportions or just a status whore. Neither is particularly good.

I don’t have any respect for a company that makes me buy a $800 phone then tells me what I can and cannot do on it and puts so many limitations on it (BT can’t transfer files, seriously? The only prescription that can cure what Apple has become today it’s a large dose of their own medicine.

iSteve was the first to change, might have been his comeback with a vengeance after his baby was taken away from him, but in the process he did lose something unfortunately… proof is that he forgot where he came from and how hard people stood behind his company even when he had long been “forcibly removed” from it by a bunch of egregious imbeciles. Sadly Apple has forgotten what it means to be the underdog, what it means to have the backing of dedicated supporters who will stay with the company no matter how hard it is not to be able to find a printer or other peripheral that works with your computer, no matter how much you would like to use some applications that are not available to your OS and despite of having to pay through the nose for Apple specific hardware and having to buy limited expensive system upgrade that sometimes took weeks or months to get. Those who remember those times are the people who are definitely not proud of the new Apple and the shameful throwing money to patent lawyer sharks who feast on the billions the company collects on products… instead of prices going down for their products as sales soar and instead of putting those funds to good use Apple rather engage in endless patent battles with companies that are not even close to dominating the market. A very sad display that for the old school Apple supporter is the exact opposite of what Apple used to stand for.An iSteve stating “I am willing to go thermonuclear on Android because it’s a stolen product” not only makes an entirely false statement, but it completely forgets that he himself admitted to the fact that the Mac OS (Classic pre X) had been almost entirely lifted from the OS that had been developed back then by Xerox… in his own admission he even repeated Picasso’s famous quote “good artists copy, great artists steal” justifying himself and saying that even if Mac OS started from something already existing the Apple completely revolutionized the initial concept. If Xerox was to use the same practices that Apple uses today, there simply would be no Apple. And what to say about those who troll in favor of Apple across the web? They are most likely people whose first Apple purchase was an i-Something. Or even worse… they are the same people who before the iWorld were bashing Apple and Mac and were trolling against Apple in favor of Windows. Times do change indeed… and it’s not always for the best.

no chance. This is just hype to get publicity. Really? The US economy needs Apple now. And if Apple lost, the only loser is the consumer.”
No chance? Apply already got an injunction against the Galaxy Nexus and other devices, despite it not looking or functioning anything like an iPhone . While it’s currently being stayed, it WAS the goal of Apple. That’s all Google is going to do. They aren’t after licensing fees. They want Apple to feel what it’s like with the shoe on the other foot. A 1-day injunction is enough of a gesture to tell them to chill out and play nice. The US doesn’t NEED Apple right now. The economy needs affordable options… not luxury devices. The patents Google is asserting are pretty iron-clad in this case.
I say more power to them (Google) for their attempts to stop this “litigation not innovation” crap that Apple has taken to of late. They deserve to feel the pain, even if it is only for a short period of time.
