Obvious: Samsung Appeals US Galaxy Nexus and Galaxy Tab 10.1 Ban

A few days ago, we had to share the awful news that Apple has set its sights on the Galaxy Nexus and Galaxy Tab 10.1, particularly in regards to blocking the devices from being sold in the United States. As a quick followup to that story, we just wanted to let you know that Samsung has appealed the temporary ban, moving to stay the injunction. You didn’t really think ol’ Sammy was just going to roll over on this one, did you?

Samsung is arguing that the ban is “inconsistent with the Federal Circuit’s directive that market share losses must be substantial and attributable to the ‘infringing feature,’ not just the presence of the infringing product on the market.” Of course, whether or not the judge decides to grant this appeal is still up anybody’s guess. We’re just going to have to wait and see how this plays out in the courtroom.

Let’s just hope we don’t end up with the sheep winning this battle.

    Granting the injunction is an overreach by the court. The litigation between Apple and Samsung has yet to decided and neither has the damage (if any) to Apple. Even if Apple wins, it will only result in a financial reward not an import ban on Samsung devices, so granting that now, albeit temporary, seems to me like an overreaction by the court. I wonder if Google will be treated so favorably in their action against Apple?
